He Stabbed a 23-Year-Old Refugee in Front of Witnesses on a Packed Train. Now the Courts Say He Can’t Be Tried

Iryna Zarutska fled a war. She survived months hiding in a bomb shelter. She crossed an ocean for safety. On August 22, 2025, she boarded a light rail train in Charlotte, North Carolina — and never came home. Now, the man accused of killing her has been found mentally unfit to stand trial.
The case that shocked a nation has just taken its most gut-wrenching turn yet.

### She Came Here to Be Safe
Iryna Zarutska was 23 years old when Russia invaded Ukraine in 2022. She fled with her mother, sister, and younger brother, eventually settling with relatives in Huntersville, North Carolina — a suburb of Charlotte. By all accounts, she was building a life.
Then came that Friday night in August.
Surveillance video shows Zarutska entering the train car and sitting down in front of Decarlos Brown Jr. Roughly four minutes later, Brown allegedly pulled a knife from his pocket and stabbed her three times from behind before departing the train. WFMD-AM Passengers rushed to help her. She died on the train from her injuries. newsner
Brown was arrested minutes later on the platform. The footage went viral, reaching all the way to Washington.

### A Case That Became a Political Firestorm
That September, the footage was publicly released and went viral, reaching the White House. In February, President Donald Trump invited Zarutska’s mother to the State of the Union, where he called Brown a “deranged monster” and falsely claimed he “came through open borders” — Brown was born in Charlotte. The Assembly NC
Since then, murals honoring Zarutska in U.S. cities have been vandalized, and a mural in Providence, Rhode Island was ordered removed by the city’s mayor, who called it “divisive.” American Greatness
Back in North Carolina, the case moved through two parallel tracks — state and federal.

### What the Court Documents Reveal
A state psychiatric facility determined that Brown is “incapable to proceed” on the state murder charge. The case is expected to be delayed until the court deems his capacity “restored.” WBTV
Brown’s attorney, Daniel Roberts, asked a judge to delay Brown’s Rule 24 hearing — a mandatory pretrial proceeding in death penalty cases — for 180 days. A hearing is currently scheduled for April 30. WRAL.com
Brown, a homeless man diagnosed with schizophrenia, is currently held in federal custody on separate charges relating to the attack. WFMD-AM Both the state first-degree murder charge and the federal charge — committing violence against a mass transportation system resulting in death — remain active.

### “They Were Controlling Me” — Brown’s Own Words
This outcome did not come from nowhere. Starting in 2024, Brown’s interactions with Charlotte-Mecklenburg police suggested he was spiraling into a mental health crisis. On one occasion, officers were dispatched to a hospital five times in a single day because Brown, described in incident reports as a “schizophrenic individual,” kept calling 911. The Assembly NC
In a jailhouse phone call to his sister just days after the killing, Brown said he did not understand why he stabbed Zarutska, claiming the government had implanted “materials” in his brain that were “controlling” his actions. WFMD-AM
His sister, Tracey Brown, told Spectrum News 1 she was not surprised. “I’ve known about his struggles for years,” she said, adding that she is sad the loss of life had to happen before his condition was taken seriously. “I just hope both families get justice. I hope this situation opened a lot of people’s eyes on mental health.” Spectrum News 1

### Here’s What We Know

August 22, 2025: Iryna Zarutska, 23, is fatally stabbed aboard Charlotte’s Lynx Blue Line train.
October 22, 2025: A federal grand jury indicts Brown on charges of committing violence against a railroad and mass transportation system resulting in death. newsner
December 29, 2025: Central Regional Hospital completes its psychiatric evaluation, finding Brown “incapable to proceed.” WBTV
April 7, 2026: Brown’s public defender files a motion in Mecklenburg Superior Court revealing the findings and requesting a 180-day delay.
A judge has yet to formally accept the evaluation’s findings. Until then, the murder charge technically remains pending.

### Why This Matters Beyond One Case
In North Carolina, restoring someone’s competency to stand trial can take over a year, largely because there are not enough beds in state psychiatric hospitals. WRAL.com Brown’s case is now caught in that bottleneck — and may remain there indefinitely.
Lauren Newton, attorney for the Zarutska family, says there are unresolved questions about whether anything will be done to restore Brown’s capacity so the case can actually move forward. Spectrum News 1
Meanwhile, the federal case — which carries a possible life sentence or death penalty — continues on a separate track.

Iryna Zarutska survived bombs, displacement, and the collapse of everything familiar — only to be killed on a commute. Her family is still waiting for a trial that may not happen for years, if ever. The system that failed to intervene before the attack is now struggling to deliver justice after it.
Her mother sat in the gallery of the U.S. Congress. The whole country watched. And still, the question hangs in the air: Will anyone ever be held accountable?
